BIAA Files Petition for Cert with Supreme Court in NFL Case

Vienna, Va. – The Brain Injury Association of America (BIAA) submitted an amicus brief to the United States Supreme Court regarding the National Football League (NFL) concussion litigation, requesting the high court intervene and grant a petition for a writ of certiorari filed by the Armstrong petitioners in August.

As the voice of brain injury, BIAA has an obligation to provide the Court with unbiased, accurate information on the consequences of traumatic brain injury (TBI) and to protect the integrity of scientific research on TBI. “We want the NFL concussion settlement to help all of the players it was intended to help,” said Susan Connors, president and chief executive officer of BIAA, the nation’s leading brain injury patient advocacy organization.

In the brief, which was written and submitted by BIAA board member Shana De Caro, Esq., and Michael V. Kaplen, Esq., Professorial Lecturer in Law, The George Washington University Law School, the authors argue the settlement excludes the vast majority of conditions and consequences of TBI and does not provide effective treatment options for class members. “Brain injury victims are entitled to dignity, respect, and recognition. Unfortunately this settlement provides none of these,” Kaplen said.
